Suing over what damages? The product comes with a warranty which will be honored so this seems to be about as frivilous a lawsuit as there could possibly be. Manfacturers are not required to produce products with 100% relability, and consumers that bite on launch day should have the sense to expect some launch day issues. But the bottom line is that the "damages" are totally mooted by the exsistence of a warranty. Good luck.

Is "too much screen time" really a problem?
Yes -- smartphone addiction is ruining relationships.
Yes -- but primarily due to parents' failure to regulate kids' use.
Possibly -- long-term effects on health are not yet known.
Not really -- lack of self-discipline and good judgement are the problems.
No -- angst over "screen time" is just the latest overreaction to technology.
No -- what matters is the quality of content, not the time spent viewing it.
